Terms of Service

These terms govern the use of Legacy Videos HK services. We have written them in plain English because we would rather be understood than protected by complexity. If anything is unclear, please ask us before you book.

1. Who we are

Legacy Videos HK ("we", "us", "our") is a service offered through Breaking Rice Studios Limited, a Hong Kong company. References to "we" in these terms include Breaking Rice Studios Limited.

2. Acceptance

By submitting an enquiry, booking a consultation, or signing a project proposal, you accept these terms. If you do not accept, please do not submit an enquiry or book a project with us.

3. Our services

We provide cinematic life-story video production, including:

  • Tribute — a short (6–10 minute) film, photo-based or recorded message
  • Signature Farewell — an up to 30 minute in-home filmed conversation, full production
  • Legacy Documentary — a feature-length documentary (up to 60 minutes), bespoke

Each project is scoped via a written proposal that defines deliverables, timeline, and price. The proposal forms part of these terms.

4. Pricing and payment

Published prices are starting points ("from HK$X") for general guidance. Each project is scoped individually with a written proposal that specifies the final price. The proposal price is what you pay.

Payment terms are specified in the project proposal. Generally:

  • 50% deposit due upon signing the proposal to confirm the booking
  • 50% balance due upon delivery of the final film

All prices are in Hong Kong Dollars (HK$) and exclusive of any bank transfer fees. We accept bank transfer, FPS, and PayMe by default. Other methods available on request.

5. Cancellation and rescheduling

Before filming has occurred:

  • Cancellation more than 30 days before the scheduled filming date: full refund of the deposit, minus any non-recoverable third-party costs already incurred (typically minimal)
  • Cancellation 14–30 days before filming: 50% of the deposit is refundable
  • Cancellation less than 14 days before filming: deposit is non-refundable

After filming has occurred: The full project fee is non-refundable. We have already performed substantial work and incurred editing time. We will, however, deliver the work we have produced to date.

Rescheduling: Free, with at least 14 days notice, subject to availability. Less than 14 days notice may incur a rescheduling fee.

Our right to decline: We reserve the right to decline or cancel a project at any time before filming, in which case all fees paid will be refunded in full. We do this only in exceptional circumstances.

6. Revisions and approval

Each package includes a specific number of revision rounds (Tribute: 1, Signature: 2, Legacy: bespoke). A "revision round" means one consolidated set of feedback from you, not individual line-items. We will work with you to ensure the final film is true to your story.

Once you approve the final film, no further revisions are included. Additional revision rounds are available at the rates listed on the packages page.

7. Ownership and rights

Upon full payment, you own the final film in its delivered form. We retain the right to retain backup copies of the raw footage and the final film for our records.

We will never use your footage, your story, your family's image, or your name in any of our marketing, social media, portfolio, or third-party distribution without your separate written permission. Even with permission, we will never attach your real name to a quote without a separate signed release.

We retain the underlying copyright in the production techniques, editing approach, and the film as a creative work. You have a perpetual, non-exclusive license to use, share, and reproduce the final film for personal, non-commercial purposes, including private family screenings and distribution to family members.

8. Intended use — private, not for public distribution

The films we produce are intended as private, family-only works. They are not designed, licensed, or insured for public distribution, broadcast, or commercial exploitation.

Music and third-party content: Any music, archival footage, photographs, or other third-party material included in your film is licensed to us on a private, non-commercial basis. The licences we obtain cover private family screenings and personal sharing among family members — they do not cover public posting, broadcast, or commercial use.

If you choose to publish the film publicly (for example, on YouTube, Instagram, TikTok, Facebook, or any other public platform, including paid or monetised platforms), you do so at your own risk. You are solely responsible for:

  • Any copyright infringement claims arising from the public use of third-party content in the film
  • Any fines, penalties, takedown costs, or legal fees that result from such public posting
  • Verifying that any music, archival footage, or other third-party content is licensed for the public platform you choose

We strongly recommend that the film remain private to your family. If you wish to share a portion publicly, please contact us first so we can advise on what content is safe to share and what would require re-editing or alternative licensing.

No warranty for public distribution: We make no representation that the film, as delivered, is licensed, cleared, or safe for public distribution on any platform. The responsibility for that decision, and any consequences that follow, rests with you.

9. Confidentiality

We treat all client information as strictly confidential. We do not announce that we are working with you, share that your project exists, or disclose any details about your family, your story, or your film to any third party, except as required to deliver the services (e.g., music licensing, archival research) or as required by law.

10. Liability

We carry professional indemnity insurance for our production activities. Our total liability for any claim arising from or related to our services is limited to the total fees paid by you for the specific project in question.

We are not liable for:

  • Indirect, consequential, or incidental damages
  • Loss of data caused by factors outside our reasonable control (e.g., natural disasters affecting our backup systems)
  • Acts of third parties we use to deliver the services (e.g., music licensing disputes, archival source unavailability)
  • Subject matter provided by you that infringes third-party rights

Nothing in these terms limits any liability that cannot be excluded by Hong Kong law.

11. Force majeure

We are not liable for failure to perform our obligations due to events beyond our reasonable control, including but not limited to: natural disasters, government actions, public health emergencies, civil unrest, or significant illness of key personnel. In such cases, we will work with you to reschedule or refund fees paid for undelivered services.

12. Termination

By you: You may terminate a project at any time by written notice. Refund terms per section 5 apply.

By us: We may terminate a project for material breach of these terms (e.g., abusive conduct, illegal subject matter, non-payment) with 14 days written notice. Fees for work already performed are non-refundable in such cases.

13. Governing law and disputes

These terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute arising from or related to our services will be resolved through good-faith negotiation first. If negotiation fails, disputes will be subject to the exclusive jurisdiction of the courts of Hong Kong.

You may also have the right to refer a consumer dispute to the Hong Kong Consumer Council, or to seek mediation through the Hong Kong Mediation Centre.

14. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via the contact details you have provided us, with at least 14 days advance notice. Continued use of our services after the effective date of changes constitutes acceptance.

15. Severability

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions continue in full force and effect.

16. Entire agreement

These terms, together with the project proposal and our privacy policy, constitute the entire agreement between you and us regarding our services, and supersede any prior communications or representations.
